Company Plan Terms

FledgePoint · Version of October 20, 2026

These terms apply when a company or project team uses a company plan or project plan on FledgePoint. A company admin accepts them once, online, for the whole company. Everyone on the plan also follows the Terms of Use.

1. The plan

A company plan gives your company access to the tools and toolboxes listed for it on FledgePoint (“the plan”). A project plan gives a project team a toolbox built for that project. What your plan includes, its start date, any pilot period and its price are set out in the quote or invoice we agree with you (“your order”). If your order and these terms disagree, your order wins for that point.

2. Toolbox licenses

  • What a toolbox license is. A project toolbox (for example, a toolbox built around one project’s Biological Opinion) is licensed to your company for one named project and one term, as set out in your order. Unless your order says otherwise, the term is one year and renews as described in section 6.
  • Setup. Adding your project’s own details (contacts, rotations, schedules, site rules and similar) is a one-time setup service, priced in your order. We do that work only after a company admin approves it in writing on FledgePoint.
  • What you run. Your company admins decide who on your team uses the toolbox and until when, and post your updates and weekly schedule. We build, maintain and update the toolbox content itself.
  • When the work changes hands. The license is tied to your company’s work on that project. If your company stops working on the project, its license for that toolbox ends, and we may license the same toolbox to whoever takes over. Your own data stays yours (section 7) and is not shared with the new company.

3. People on the plan

  • Plan size. Your order sets how many people and active projects your plan includes. You can see your usage on your company page. If you grow past it, we agree the right plan with you; nobody is locked out automatically.
  • Personal accounts. Each person uses their own FledgePoint account. Accounts may not be shared.
  • Your people only. Seats are for your employees and, on project toolboxes, the contractors and crews you add for that project. They are not for resale or for other companies’ unrelated work.
  • Leaving. When someone leaves your company or project, remove them or let their access end on the date you set. Their personal account, their own purchases and their own saved records stay with them.

4. Company admins

Your company names one or more company admins. Company admins can add and remove people, set roles and access dates, and manage your toolboxes. You are responsible for what your admins do on FledgePoint and for keeping your people list current. The person who accepts these terms confirms they are allowed to accept them for the company.

5. Contractors and crews

On a project toolbox you may add people from other firms as contractors, and name a field lead from a subcontracted firm as a crew lead who manages their own crew. They see only the project toolboxes you give them, never past the access you set. Only what your plan includes can be shared this way. A contractor’s own company may hold its own plan; each plan covers only its own company, and neither pays for the other.

6. Pilot, fees and renewal

  • Pilot. If your order includes a pilot, the plan is free or discounted until the pilot end date. Before it ends we will agree whether the plan continues and at what price. Nothing renews into a paid plan without your written OK.
  • Fees. Paid plans are quoted and invoiced, usually yearly in advance. Invoices are due within 30 days.
  • Renewal. A paid plan renews for the same length unless either side says otherwise at least 30 days before the renewal date. Any price change for the next term will be told to you at least 60 days before renewal.
  • Taxes. Prices do not include sales or similar taxes, which are added where they apply.
  • Late payment. If an invoice is more than 30 days overdue, we may pause the plan after giving your admins notice. Your people keep their personal accounts.

7. Your data

  • You own it. Field records, photos, documents and project details your people enter belong to your company or to the person who made them, as between you and us.
  • How we use it. We store and process it only to run FledgePoint for you, keep it secure and give support. We do not sell it, and we do not share it with other companies on FledgePoint.
  • Confidential project information. Permits, Biological Opinions, site maps and similar documents you share with us for a toolbox are kept confidential and used only to build and maintain your toolbox.
  • Your responsibility. Only upload what you are allowed to share, and keep sensitive species locations to the people who need them.

8. What stays ours

  • Ownership. FledgePoint and everything we make for it belong to Travel Twist Biologist LLC: its software, tools, toolboxes (including project toolboxes made from your documents), The BO, Illustrated, the Study Modules and their questions, guides, illustrations, photos, maps we draw, page layouts, the way the content is selected, organized and presented, and every update or improvement to any of them, including improvements made from your suggestions. Your plan does not transfer ownership of any of it.
  • Your right to use it. While your plan or toolbox license is active, your company may let its own people (and the contractors it adds) use the tools through their own FledgePoint accounts, for your own work on the projects in your order. That right is non-exclusive and non-transferable, and you may not sublicense it.
  • What you agree not to do. You will not, and will not let anyone else: copy, download in bulk, print or export the content to rebuild it elsewhere; reproduce or imitate the tools’ content, structure, format or design in your own or anyone else’s materials, training, apps or documents; resell, rent or share access with anyone outside your plan, or share logins; give the content to a competitor of ours; scrape, copy the code of, reverse engineer or try to get around access controls; use the content to build, or to train an AI system for, a product or service that competes with ours; or remove our name, copyright or trademark notices. Normal field use, including short notes and an occasional printout for your own crew’s use on the project, is fine.
  • Your people. You are responsible for your people and contractors following this section, and you will tell us promptly if you learn that someone has not.
  • Ideas and feedback. If you send ideas or suggestions, we may use them freely to improve FledgePoint, without owing you anything for them. Your confidential project information stays covered by section 7.
  • Our confidential information. Anything about FledgePoint that is not public (prices in your order, unreleased tools, drafts, how the tools are built) is confidential. Share it only with your people who need it for the plan.
  • Names. Travel Twist Biologist, FledgePoint and The BO, Illustrated are our names and marks. You may not use them for your own products.
  • If this section is broken. Copying or misuse could cause us harm that money alone would not fix, so we may ask a court to stop it right away, in addition to any other remedy, and we may suspend the access involved. This section continues to apply after the plan ends.
  • Your project facts stay yours. Nothing here gives us ownership of your project-specific facts, records or documents (section 7).

9. Updates and support

Tools in your plan are updated as agency guidance changes and as crews send feedback, at no extra cost. We may improve, rename or reorganize features; we will not take away something your plan depends on during a paid term without offering a fair replacement or a prorated refund. Support is by email at support@fledgepoint.com, usually within two business days.

10. Ending the plan

  • Either side may end the plan at the end of a term by giving 30 days’ notice.
  • Either side may end it sooner if the other seriously breaks these terms and does not fix it within 30 days of written notice. If we end it for our breach, we refund the unused part of any prepaid fees.
  • When the plan ends, company access stops. Every person keeps their personal account, their own purchases and their own saved records. For 30 days after the end, a company admin can ask us for an export of the company’s records, after which company project data may be deleted.
  • When the plan or a toolbox license ends, your company and its people stop using the tools covered by it and delete or destroy any copies of our content they kept, apart from what the law requires you to keep. Sections 7, 8, 11 and 12 continue to apply after the end.

11. Field use and limits

The tools support your crews; they do not replace permits, Biological Opinions, agency direction or the project biologist’s judgment, which always govern. We work to keep content accurate but do not promise it is complete or current for every project. Apart from what these terms say, FledgePoint is provided as it is. To the extent the law allows, neither side is liable for indirect or consequential losses, and each side’s total liability under these terms is limited to the fees your company paid for the plan in the 12 months before the claim. These limits do not apply to misuse or copying of the other side’s property or confidential information.

12. General

  • Changes. If we change these terms, we will post the new version here with its date and tell your company admins on FledgePoint. Changes apply from your next renewal unless you agree sooner.
  • Public mention. We will only name your company or show your logo as a customer outside FledgePoint with your permission.
  • Assignment. Neither side may hand this agreement to someone else without the other’s OK, except as part of selling the business.
  • Law. These terms are governed by the laws of the State of Texas, where Travel Twist Biologist LLC is organized.
  • Each part stands alone. If a court finds part of these terms can’t be enforced, that part is applied as far as the law allows and the rest still applies.
  • Whole agreement. These terms, your order and the Terms of Use are the whole agreement for the plan. If we don’t enforce a term right away, we can still enforce it later.

Company admins accept these terms online, once, from this page. Questions before accepting? Email me.
