Travel Twist Biologist LLC
Terms of Use
FledgePoint · Updated October 27, 2026
Who these terms are with
FledgePoint is owned and run by Travel Twist Biologist LLC (“we”, “us”). By creating an account or using FledgePoint, you agree to these terms. If you purchase a paid tool or subscription, the purchase policy and Individual Tool License also apply and are presented before checkout. How we handle your information is explained in the Privacy Policy. If you use FledgePoint for a company, you confirm you may agree for that company.
Your account
Browsing and account creation are free. Creating an account does not start any payment.
- You must be at least 18 and able to enter a contract to use FledgePoint.
- Give accurate sign-up details and keep your password private. You are responsible for what happens under your account; tell us right away at support@fledgepoint.com if you think someone else has used it.
- One person per account. Accounts may not be shared.
- Your account allows two signed-in browser sessions. Signing in on a third browser signs out the oldest session. You can sign out other devices from Your account.
What we own
FledgePoint and everything in it belong to Travel Twist Biologist LLC: the software, tools, toolboxes, written guides, protocols, illustrations, artwork, layouts, names and logos, the way content is selected, organized and presented, and every update or improvement to any of it. Nothing is sold to you. You receive a limited, non-exclusive, non-transferable permission to use the parts your account has access to, for your own field and office work, for as long as your access lasts.
What you own
Your own entries, field records, photos and documents stay yours. You let us store and process them only to run FledgePoint for you. Project information a company provides stays that company’s.
What you may not do
- Copy, reproduce, republish, resell or share FledgePoint’s content, tools, guides or illustrations, except the completed work you produce for your own projects.
- Scrape, download in bulk, record, or use automated tools to collect content from FledgePoint.
- Reverse engineer, decompile or try to extract the source code or templates.
- Use FledgePoint, or anything learned from it, to design, build or market a product or service that competes with it.
- Share your login, or let someone use your access who is not covered by your account or your company’s plan.
- Sign up for the purpose of studying FledgePoint for a competing business.
- Reproduce or imitate the content, structure, format or design of the tools (including The BO, Illustrated, the Study Modules and their questions) in your own or anyone else’s training, apps, documents or presentations, including by screenshots or retyping.
- Give FledgePoint content to anyone outside your account or your company’s plan, including a competitor of ours.
- Use FledgePoint content to train, prompt or build an AI system or other product that competes with FledgePoint.
- Remove or hide our name, copyright or trademark notices, or remove, cover or crop the “Licensed to” mark on pages and printouts.
Normal field use is fine: short notes for yourself and an occasional printout for your own work on your project.
Ideas and feedback
If you send ideas, suggestions, bug reports or other feedback, we may use them freely, for any purpose and without time limit, to improve FledgePoint, without owing you payment or credit. Please don’t send anything you consider confidential.
Reviews you post may be shown on FledgePoint or in our marketing with the name, initials or company you chose when posting. Reviews given in exchange for free access are labeled as such.
Project information you see
Through a project toolbox you may see another company’s project details: contacts, schedules, site rules and documents. Use them only for your work on that project, and don’t share them outside it.
Company plans and toolboxes
A company plan is a separate written agreement between a company and Travel Twist Biologist LLC. It covers the people the company adds, for the term agreed, under the Company Plan Terms. Toolboxes built for a company or project, including their written and illustrated content, remain the property of Travel Twist Biologist LLC; the company receives access for the agreed term. Your access to a company’s toolbox can end when your work on that project ends, or when the company’s plan or license ends.
Beta
FledgePoint is in beta: it is still being built and tested. Features may change, move, become paid, or be removed, and there may be errors, bugs or interruptions. By using it during the beta you accept that. Free beta access can end, or what it includes can change, at any time. Keep your own copies of anything important you create; we back up FledgePoint nightly, but we cannot promise that no data will ever be lost.
Free access and claimed offers
Some tools are free for a stated period, for example 6 months free. The period, and what it includes, is shown when you claim it. Free access is personal to your account, has no cash value, and cannot be transferred, sold or combined with another offer unless we say so. One claim per person.
Free access never turns into a charge on its own: we do not ask for a card to claim it, and nothing renews or bills automatically. When a free period is ending, we will tell you by email or on your dashboard before it ends. After it ends you can keep using the tool only by choosing to buy it at the price shown at that time, and your saved entries are handled as the purchase policy and Privacy Policy describe. We may end or change an offer for new claims at any time, and may end free access early for an account that breaks these terms.
Protecting the content
To protect FledgePoint and its users, we keep a record of the pages and documents each account opens and the kind of device each sign-in comes from, and guide pages and printouts show the name of the person they are licensed to and the date. We use these records to keep FledgePoint secure, to spot misuse such as bulk downloading or shared logins, and to enforce these terms. If we find misuse we may contact you, limit your access, or end your account. The Privacy Policy explains these records and how long we keep them.
Field use and your judgment
The tools support your work; they do not replace permits, agency guidance, project requirements or your professional judgment. Always follow the current permit, biological opinion and agency direction for your project. We work to keep content accurate, but we do not guarantee it is complete or current for every project.
Not professional, legal or agency advice. Nothing in FledgePoint is legal, regulatory, permitting or professional advice. FledgePoint is not affiliated with, reviewed by or endorsed by the U.S. Fish and Wildlife Service, the Bureau of Land Management, any state agency or any project owner; agency names appear only to identify sources and forms.
What you submit is yours to check. Forms, reports, logs and documents you make with FledgePoint (for example a Desert Tortoise Qualifications Form) are your own statements. Review every entry, total and page for accuracy before you sign, submit or rely on it. The agency or client decides what it accepts; FledgePoint does not guarantee any approval, authorization, permit or outcome.
Safety in the field. Fieldwork has real risks, including heat, terrain, wildlife, weather and vehicles. You are responsible for your own safety and for following your employer’s safety plan and the project’s rules. Do not use FledgePoint while driving. Locations, coordinates, weather and other readings come from your device or outside services and can be wrong; confirm anything important another way.
Your device and outside services. Some tools keep data on your phone or browser so they work with a weak signal; clearing your browser or losing your device can delete it, so sync or download what you need. FledgePoint links to and uses outside services (for example agency websites, maps, weather and email providers) that we do not control and are not responsible for.
Suspending or ending access
We may suspend or end an account that breaks these terms, puts others at risk, or is used to copy or compete with FledgePoint. You may close your account at any time from Account → Your data, or by emailing us. Access to paid tools follows the purchase policy.
When your access to something ends, stop using it and delete any copies of our content you kept. The sections on what we own, what you may not do and project information keep applying after your access ends. Because copying or misuse could cause harm that money alone wouldn’t fix, we may ask a court to stop it right away, in addition to any other remedy.
No warranties
FledgePoint and its content are provided “as is” and “as available”. To the extent the law allows, Travel Twist Biologist LLC makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or that FledgePoint will be uninterrupted or error-free. Field references, illustrations, checklists and calculations are aids; you are responsible for checking them against the current permit, Biological Opinion, agency protocol and project requirements before relying on them.
Limits on liability
To the extent the law allows, Travel Twist Biologist LLC, its owner, members and contractors are not liable for any indirect, incidental, special or consequential losses, including lost profits, lost data, project delays, stop-work orders, permit violations, fines or penalties, arising from use of or inability to use FledgePoint, whether the claim is based on contract, negligence or anything else, and even if we were told such a loss was possible. Our total liability for all claims together is limited to the greater of what you paid us in the 12 months before the claim or $100. During free use you have paid nothing, so the $100 limit applies. Some places do not allow certain limits, so some of these may not apply to you.
Your responsibility to us
If you misuse FledgePoint, break these terms or the law, or upload content you had no right to share, and that leads to a claim against Travel Twist Biologist LLC, you agree to cover the reasonable costs of that claim, including legal fees.
Disputes and governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Before filing any claim, please email support@fledgepoint.com and give us 30 days to try to resolve it informally. Any claim must be brought individually, not as part of a class action, in the state or federal courts located in Harris County, Texas, unless the law requires otherwise or we both agree to another forum. Either side may bring a qualifying claim in small-claims court. To the extent the law allows, any claim must be brought within one year after it arises, or it is permanently barred.
General
If any part of these terms cannot be enforced, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer your account or these terms; we may transfer them as part of selling or reorganizing the business.
Changes
We may update these terms. When we make a meaningful change, we will show the new date here and tell signed-in users on FledgePoint.
